By accessing or using Gardiflora ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Gardiflora is a gardening companion application that helps you:
- Organize and manage your gardens, plants, and garden structures
- Track seasonal gardening tasks
- Identify plants using AI-powered image recognition
- Monitor biodiversity and ecological impact
- Access gardening tips and knowledge
3. User Accounts
To use Gardiflora, you must create an account. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
You must be at least 13 years old to create an account and use the Service.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Upload malicious content, viruses, or harmful code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or its servers
- Use automated systems to access the Service without permission
- Resell or commercially exploit the Service without authorization
5. User Content
You retain ownership of content you create in Gardiflora (garden data, notes, photos). By using the Service, you grant us a limited license to store, display, and process your content solely to provide the Service to you.
You are responsible for ensuring you have the right to upload any content, including photos, that you add to the Service.
6. Plant Identification Service
The plant identification feature uses AI technology provided by PlantNet. Please be aware that:
- Identifications are suggestions and may not always be accurate
- You should verify identifications before making decisions, especially regarding edibility or toxicity
- We are not liable for any harm resulting from reliance on plant identifications
- Never consume plants based solely on AI identification
7. Gardening Advice Disclaimer
Gardiflora provides general gardening information and task suggestions. This information is for guidance only and should not be considered professional horticultural advice. Gardening conditions vary by location, climate, and individual circumstances. We are not responsible for plant loss, garden damage, or other outcomes resulting from following suggestions in the app.
8. Content Generation Disclosure
The plant information, gardening tasks, and educational content in Gardiflora were researched and generated with the assistance of generative AI tools, then reviewed for accuracy. Where possible, we display original sources for the information shown so you can verify and explore further.
While we strive for accuracy, this content is provided for general guidance and should not replace professional horticultural advice. We do not claim exclusive copyright over AI-generated portions of this content.
9. Intellectual Property
The Gardiflora name, logo, and all related graphics, user interface, and software are owned by or licensed to us. You may not copy, modify, distribute, or create derivative works based on our intellectual property without written permission.
10. Third-Party Services
Gardiflora integrates with third-party services (PlantNet, Google, Supabase). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.
11. Service Availability
We strive to keep Gardiflora available and functional, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice when possible.
12. Subscriptions and Payments
Gardiflora offers an optional paid subscription, Bloom, which unlocks premium features. Some features of the Service are free to use, while others require an active Bloom subscription.
Pricing. The price of a subscription is shown on the purchase screen before you confirm, in your local currency. Prices may vary by country and platform and may change over time. We do not list prices in these terms because the purchase screen always shows the current, applicable price.
Auto-renewal. Bloom is an auto-renewable subscription. It renews automatically for the same period at the then-current price unless you cancel before the current period ends. Your account is charged when you confirm the purchase and again at the start of each renewal period.
Managing and cancelling. You can manage or cancel your subscription at any time:
- Purchases made through the Apple App Store: in your Apple account settings. To avoid renewal, cancel at least 24 hours before the current period ends.
- Purchases made through the Google Play Store: in your Google Play account settings.
- Purchases made on the web: through your account or by contacting us.
Cancelling stops future renewals. You keep access to premium features until the end of the period you have already paid for.
Free trials and introductory offers. If a free trial or introductory offer is available, its terms are shown at the point of purchase. If you subscribe during a free trial, any unused portion of the trial ends when the paid subscription begins.
Price changes. If we change the subscription price, we will notify you in advance as required by the relevant platform. If you do not accept the new price, you can cancel before it takes effect.
Refunds. For purchases made through the Apple App Store or Google Play Store, refunds are handled by Apple or Google under their respective policies. For purchases made on the web, contact us at support@gardiflora.app.
13. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid us (if any) in the past 12 months
- We are not liable for data loss; you are responsible for backing up important information
14. Account Termination
You may delete your account at any time by contacting us. We may suspend or terminate your account if you violate these terms or engage in harmful behavior.
Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
15. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new terms.
16. Governing Law
These terms are governed by the laws of Belgium. Any disputes shall be resolved in the courts of Belgium. If you are a consumer in the European Union, you retain the protection of mandatory provisions of your country of residence.
